Anti-Spam and Global Compliance Terms and Conditions

Effective Date: January 2025

By participating in the Oasis Affiliate Program – Refer and Reward (“Program”), you agree to comply with all applicable anti-spam laws, privacy regulations, and the marketing guidelines set forth by Oasis Land Development (“Oasis”). Affiliates are considered independent contractors and bear full responsibility for their marketing and promotional activities. Oasis is not liable for any violations of laws or regulations by affiliates.

Failure to comply with these terms may result in immediate termination from the Program, forfeiture of any unpaid rewards, and, in severe cases, legal action.

1. Compliance with Global Anti-Spam Laws

As a participant in the Program, you agree to strictly adhere to the anti-spam laws and regulations of any country or region where you conduct marketing activities. These include, but are not limited to:

CAN-SPAM Act (United States): Prohibits deceptive email practices and requires proper identification and opt-out options.

GDPR (General Data Protection Regulation, Europe): Requires consent for communication, data protection, and user privacy.

PECR (Privacy and Electronic Communications Regulations, UK): Covers consent requirements for email and SMS marketing.

CASL (Canada’s Anti-Spam Legislation): Requires explicit or implied consent before sending commercial messages.

Australia’s Spam Act: Prohibits unsolicited electronic messages and requires accurate sender identification and an unsubscribe option.

It is your responsibility to familiarise yourself with and comply with the anti-spam and privacy laws relevant to your marketing activities in all jurisdictions where you operate or target recipients.

2. Independent Affiliate Responsibility

Affiliates act as independent contractors and are not employees, partners, agents, or representatives of Oasis.

Oasis is not responsible for any legal violations committed by affiliates, including breaches of anti-spam laws, GDPR, or other data privacy regulations.

Affiliates agree to indemnify and hold Oasis harmless from any claims, fines, damages, or legal costs arising from their marketing activities.

3. Prohibited Activities

Affiliates are prohibited from engaging in the following activities:

1. Spamming:

Sending unsolicited emails, messages, or other forms of communication without proper consent.

Using purchased, rented, or scraped email lists.

2. Misuse of Oasis Branding:

Using the Oasis logo, name, or trademarks without prior written permission.

Modifying, editing, or altering official Oasis materials without approval.

Misrepresenting your relationship with Oasis.

3. False or Misleading Advertising:

Making unverified or exaggerated claims about Oasis products, services, or the Program.

Offering unauthorised discounts, incentives, or promotions.

4. Data Privacy Violations:

Collecting or processing personal data without proper consent.

Failing to provide users with a clear opt-out mechanism for communications.

4. Marketing Guidelines

Affiliates must use only approved marketing materials provided by Oasis.

Affiliates must comply with the Oasis Marketing Guidelines, which prohibit unauthorised changes to content, logos, or branding.

Affiliates must clearly disclose their affiliate relationship in all promotions using language such as:

“This is a paid referral link.”

“I may earn a commission if you purchase through my link.”

5. Enforcement and Consequences

1. Termination of Participation:

Oasis reserves the right to terminate any affiliate who violates anti-spam laws, GDPR, marketing guidelines, or other compliance regulations.

Terminated affiliates will forfeit any unpaid commissions and lose access to the Program.

2. Legal Action:

Oasis reserves the right to pursue legal action against affiliates who damage its reputation or cause financial harm through non-compliant activities.

3. Monitoring and Auditing:

Oasis may monitor affiliate marketing activities to ensure compliance, including reviewing email campaigns, social media posts, and other promotional content.

Affiliates are required to cooperate with any compliance audits or investigations conducted by Oasis.

6. Reporting Non-Compliance

Affiliates are encouraged to report any suspected violations of anti-spam laws, data privacy regulations, or misuse of Oasis branding by other affiliates. Reports can be submitted to:

7. Affiliate Obligations

By participating in the Program, you agree to:

Obtain explicit consent from recipients before sending any marketing communications.

Provide clear opt-out mechanisms (e.g., unsubscribe links) in all communications.

Use accurate sender information in all emails, messages, or advertisements.

Immediately cease communications with recipients who opt out of receiving further messages.

8. Data Security and Breach Responsibility

Affiliates are responsible for ensuring the security of any personal data they process as part of their marketing activities.

In the event of a data breach, affiliates must:

Notify the relevant authorities as required by local laws.

Inform Oasis within 72 hours of discovering the breach.

9. Opt-Out Requirements

Affiliates must provide a clear and functional opt-out mechanism for recipients in every marketing communication.

Opt-out requests must be honoured within 10 business days from the date of the request.

 

10. Governing Law

These Terms and Conditions are governed by the laws of the Cayman Islands, and any disputes arising from participation in the Program will be subject to the exclusive jurisdiction of the courts of the Cayman Islands.

 

11. Agreement

By participating in the Program, affiliates acknowledge and agree that:

They have read, understood, and will comply with these Terms and Conditions.

They are solely responsible for ensuring their marketing activities comply with anti-spam laws, GDPR, and other global privacy regulations.

Any breach of these terms may result in immediate termination from the Program and forfeiture of unpaid rewards.
